ACCEPTABLE USE POLICY (AUP)

This Acceptable Use Policy (“AUP”) governs all use of Growthifi LLC’s (“Growthifi,” “we,” “us,” or “our”) platform, products, software, CRM, messaging capabilities, APIs, AI systems, and agency services (“Services”). This AUP applies to all Clients, users, team members, contractors, and sub-accounts (“Client,” “you,” or “your”). By accessing or using any Growthifi Service, you agree to comply with this AUP. Violations may result in immediate suspension, account termination, financial penalties, carrier-imposed fines, or legal action. This AUP works in conjunction with the Terms & Conditions, Privacy Policy, and Anti-Spam Policy, each of which remains fully enforceable. Nothing in this AUP limits Growthifi’s rights under those agreements.

1. PROHIBITED USES

You may NOT use the Services for any activity that is illegal, harmful, abusive, deceptive, or that violates federal/state law, carrier rules, or industry guidelines. The following categories are strictly prohibited:

1.1 Illegal, Harmful, or Fraudulent Activity

Prohibited content includes (but is not limited to):

  • Fraud, scams, or deceptive practices
  • Phishing, spoofing, impersonation, or false identity
  • Money laundering or high-risk financial schemes
  • Extortion, threats, harassment, or intimidation
  • Deceptive marketing or misrepresentation
  • Violation of consumer protection laws (e.g., TCPA, CTIA, CAN-SPAM)
1.2 Restricted Industries & High-Risk Content

The following categories are prohibited unless you receive prior written authorization from Growthifi AND compliance approval from relevant carriers:

  • SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco)
  • Controlled substances (including cannabis, CBD, Delta-8/9)
  • Gambling, sweepstakes, contests, and betting
  • Payday loans, cash advances, or credit-repair services
  • Multi-level marketing (MLM), pyramid schemes, or “business opportunities”
  • Gambling or online betting
  • Political messaging (federal, state, local)
  • Debt collection, medical debt, or sensitive financial recovery
  • Weight loss, supplements, pharmaceuticals, or medical claims
1.3 Messaging Without Required Consent

You may NOT send messages to:

  • Purchased lists
  • Scraped, rented, shared, or third-party lists
  • Contacts without prior express (or express-written when required) consent
  • Recycled or reassigned phone numbers without re-permission
  • Any individual who opted out, unsubscribed, or revoked consent

You must maintain complete and verifiable proof of opt-in.

1.4 Platform Abuse & System Exploitation

You may NOT:

  • Attempt unauthorized access
  • Penetration test, reverse-engineer, or bypass platform controls
  • Send traffic designed to overload, disrupt, or degrade service
  • Circumvent rate limits, carrier rules, audits, or identity verification
  • Use automation or bots in a manner that produces abusive traffic
  • Manipulate routing, caller ID, or sender identification
1.5 Malware, Security Threats, or Harmful Code

Prohibited actions include:

  • Uploading malware or malicious code
  • Introducing viruses, Trojans, ransomware, or scripts that compromise security
  • Attempting to access data not belonging to you

2. MESSAGING, EMAIL & TELECOM RESTRICTIONS

In addition to our Anti-Spam Policy, Clients must comply with all telecom laws, including TCPA, CTIA, carrier requirements, A2P 10DLC rules, and global equivalents.

2.1 Forbidden Messaging Behaviors

You may NOT:

  • Send messages designed to artificially inflate traffic (“AIT”)
  • Send one-time passwords (OTPs) for unverified users or unknown use cases
  • Send phishing links, malicious URLs, or misleading redirects
  • Use URL shorteners that obscure final destinations (Bitly, TinyURL, etc.) unless approved
  • Mask or rotate sender IDs to evade filtering
  • Use proxy, VPN, or obfuscation to avoid carrier detection
2.2 Compliance & Liability

Client remains fully responsible for:

  • Ensuring all recipients provided valid consent
  • Maintaining opt-in/opt-out logs
  • Ensuring message content and targeting meet TCPA/CTIA requirements
  • Passing carrier audits
  • Paying any carrier fines, penalties, or surcharges

3. AI SYSTEMS & AUTOMATION RESTRICTIONS

Growthifi’s AI tools must not be used to:

  • Generate harmful, deceptive, or misleading content
  • Create messages intended to impersonate a person without disclosure
  • Automate outreach to individuals who did not consent
  • Generate legal, medical, or financial advice without proper disclaimers
  • Train external AI models using Client Data without authorization
  • Attempt to bypass telecom or email filters using AI-generated manipulation

AI is a tool, not a compliance mechanism. You must review and approve content before sending.

4. DATA HANDLING, PRIVACY, & SECURITY RESTRICTIONS

Clients must comply with all applicable privacy laws, including CCPA/CPRA, GDPR, and U.S. state laws.

4.1 You May NOT:
  • Store or process PHI; Growthifi is not HIPAA compliant
  • Upload medical, patient, or clinical data
  • Upload sensitive personal data without lawful basis
  • Attempt to access other Clients’ data
  • Share platform credentials or API keys
  • Transmit data to unauthorized third parties
4.2 Responsibility for Sub-Accounts & Users

Clients are responsible for:

  • All actions of team members and sub-accounts
  • Ensuring sub-users follow this policy
  • Monitoring account usage
  • Preventing accidental or intentional misuse

5. MANAGED SERVICES, AGENCY WORK & SCOPE OF RESPONSIBILITY

Even when Growthifi performs managed services or agency work:

  • Client remains the sole sender, advertiser, and responsible party
  • Client must approve all content, segments, and recipients
  • Growthifi does NOT verify consent, legality, accuracy, or compliance
  • Growthifi does not provide legal advice or guarantee deliverability

6. ENFORCEMENT & CONSEQUENCES

Growthifi reserves the right to immediately:

  • Suspend or throttle messaging
  • Disable sending or restrict features
  • Lock or terminate your account
  • Forward violations to carriers or regulators
  • Assess administrative, legal, or cleanup fees
  • Pass through carrier fines, penalties, or audit charges
  • Report unlawful activity to law enforcement

No refund or credit is issued for any enforcement action.

7. INDEMNIFICATION

Client agrees to fully indemnify, defend, and hold harmless Growthifi from all losses, fines, statutory damages, class-action claims, carrier penalties, attorney fees, or regulatory enforcement actions arising from:

  • Messaging practices
  • Consent failures
  • Misuse of the Services
  • Data sourcing or illegal data collection
  • Content violations
  • Fraud, abuse, or unlawful activity

This indemnity survives termination indefinitely.

8. CHANGES TO THIS AUP

Growthifi may update this AUP at any time. Continued use of the Services constitutes acceptance of all modifications.
